Terms & Conditions

By: Brittain Media provides professional photography, videography, and media production services using industry-standard practices and reasonable care; however, services are subject to factors beyond control, including but not limited to weather conditions, lighting limitations, venue restrictions, subject cooperation, equipment failure, illness, acts of God, travel delays, or other unforeseen circumstances that may affect coverage, production, or delivery. While all reasonable precautions are taken to safely store, back up, and process captured media, the client acknowledges that complete elimination of risk is not possible. In the unlikely event of partial or complete loss, damage, or failure to deliver media due to circumstances within or beyond control, liability shall be strictly limited to the total amount paid for the affected services.

 

By: Brittain Media shall not be held responsible for missed moments, compromised quality, or delays caused by client lateness, schedule changes, restricted access, interference by guests or participants, or failure to comply with production requirements. The client agrees to release and hold harmless By: Brittain Media, its owner, contractors, and representatives from any claims, damages, or legal actions arising from the use of delivered media, including third-party claims related to permissions, likeness rights, or distribution. Engagement of services constitutes full acceptance of these terms and acknowledgment that creative results are inherently subjective and may vary based on conditions present at the time of service.

By booking services with By: Brittain Media, the client acknowledges and agrees to all policies regarding scheduling, payment, production, delivery, and usage of media. A signed service agreement and any required retainer or deposit are necessary to secure the requested date and time, and no services are guaranteed until both are received. Remaining balances must be paid according to the agreed schedule and prior to final delivery of media unless otherwise stated in writing.

 

By: Brittain Media will make reasonable efforts to capture requested moments and content but does not guarantee specific poses, scenes, individuals, or outcomes due to the dynamic nature of live events and production environments. The client is solely responsible for obtaining all necessary permissions, permits, and releases for locations, venues, and participants, including minors, and for ensuring compliance with venue policies.

 

Final edited photographs and/or video deliverables will be provided within the estimated turnaround timeframe, though timelines may be adjusted based on project scope, workload, or unforeseen circumstances. All media remains the intellectual property of By: Brittain Media unless otherwise transferred through a written agreement, and clients receive a non-transferable license for personal use or agreed commercial use. Raw or unedited files are not included unless explicitly stated in writing. By: Brittain Media reserves the right to use produced content for portfolio display, social media, advertising, and promotional purposes unless the client submits a written opt-out request prior to the service date.
